1. Who we are

Aviary is a marketing platform operated by Byrdie AI, a brand of La Create Space. It lets a business (a "Workspace") manage contacts, design and send email, schedule social posts, and measure results. Aviary is available at https://aviary.byrdie.ai.

This policy covers two kinds of people: account holders, who sign in to Aviary and operate a Workspace, and recipients, whose contact details a Workspace has uploaded and who may receive email sent through Aviary. If you are a recipient, see section 8 and section 11.

2. Information we collect

Information you provide

• Account details: your email address and, if you sign in with Google, your name and profile picture.
• Workspace content: brand kit, templates, campaign copy, images, segments, and settings you create.
• Contact data: names, email addresses, companies, tags, custom fields, and notes you upload or sync into your Workspace.
• Connected services: credentials or tokens you provide to connect email, social, and commerce accounts.
• Support messages: anything you send us by email.

Information collected automatically

• Usage and device data: pages viewed, actions taken, browser type, IP address, and approximate location derived from IP, collected through server logs and session cookies.
• Email engagement: deliveries, opens, clicks, bounces, complaints, and unsubscribes reported by our email delivery provider for email sent from your Workspace.
• Social metrics: follower counts, impressions, and engagement figures for social accounts you connect.

Cookies

Aviary uses strictly necessary cookies to keep you signed in and to protect against cross-site request forgery. We do not use advertising cookies or third-party tracking pixels on the Aviary application.

3. Google sign-in and Google user data

You may sign in with your Google account. When you do, Google shares your email address, name, and profile picture with us. We use this information only to create and secure your account and to show who is signed in. We do not request access to your Gmail, Drive, Calendar, or contacts.

Aviary's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. We do not sell Google user data, use it for advertising, or allow humans to read it except with your consent, for security purposes, or as required by law.

4. How we use information

• To provide, operate, and secure Aviary and your Workspace.
• To send email and social posts that you compose and schedule.
• To generate drafts, images, and suggestions with AI models when you ask Aviary to do so.
• To report engagement and performance back to you.
• To honor unsubscribe requests and suppress addresses that bounce or complain.
• To respond to support requests and notify you about service changes.
• To detect abuse, enforce our Terms of Service, and comply with law.

We do not sell personal information and we do not use Workspace content or contact data to train AI models.

5. How we share information

• Service providers listed in section 6, only as needed to run Aviary on our behalf.
• Within your Workspace: other members of your Workspace can see the content and contacts in it.
• Legal reasons: when required by law, subpoena, or to protect the rights and safety of Byrdie, our users, or others.
• Business transfers: if Byrdie is involved in a merger, acquisition, or asset sale, subject to this policy.

6. Service providers

These providers process information on our behalf under their own security and privacy commitments.

7. Data you bring into Aviary

For contact data and other content a Workspace uploads, the Workspace owner is the data controller and Byrdie acts as a processor following the owner's instructions. The Workspace owner is responsible for having a lawful basis to collect that data, for obtaining any consent needed to email those contacts, and for honoring recipients' requests. Byrdie processes that data only to provide the service.

8. Email sending and recipients

Every marketing email sent through Aviary includes the sender's identity, a physical mailing address, and a one-click unsubscribe link, and carries List-Unsubscribe headers. If you unsubscribe from a Workspace's email, Aviary records that choice and blocks further marketing email from that Workspace to your address. Addresses that hard-bounce or generate a spam complaint are automatically suppressed.

If you received email through Aviary and want to know what a Workspace holds about you or want it deleted, contact the sender using the address in the email footer, or contact us at info@lacreatespace.com and we will relay your request to the Workspace owner.

9. Data retention

• Account and Workspace data is kept while your account is active and for 30 days after you close it, then deleted.
• Suppression records (unsubscribes, bounces, complaints) are kept as long as needed to keep honoring them, even after other contact data is deleted.
• AI generation records, including the prompt and inputs used, are stored with the generated output so you can audit what was created.
• Server logs are kept for up to 90 days.
• Backups are rotated on a rolling basis and are not accessible to users.

10. Security

Data is encrypted in transit with TLS and at rest by our hosting providers. Access to Workspace data is enforced at the database layer with row-level security, so members of one Workspace cannot read another's data. Secrets for connected services are stored server-side and never sent to the browser. No system is perfectly secure, and we cannot guarantee absolute security.

11. Your rights and choices

Depending on where you live, you may have the right to access, correct, export, restrict, or delete your personal information, and to object to certain processing.

• Account holders can edit profile and Workspace data in Settings, and can request account deletion by emailing us.
• Recipients can unsubscribe using the link in any email, and can contact the sender or us as described in section 8.
• Google sign-in can be revoked at any time from your Google Account permissions page.

California residents have rights under the CCPA, and residents of the EEA, UK, and Switzerland have rights under the GDPR and UK GDPR. We do not sell or share personal information for cross-context behavioral advertising. To exercise any right, email info@lacreatespace.com. We will verify your identity and respond within the time required by law.

12. Children

Aviary is a business tool and is not directed to anyone under 18. We do not knowingly collect information from children. If you believe a child has provided us information, contact us and we will delete it.

13. International transfers

We are based in the United States and our service providers store data primarily in the United States. If you use Aviary from elsewhere, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.

14. Changes to this policy

We may update this policy from time to time. We will post the new version here and update the date at the top. If a change materially reduces your rights, we will notify account holders by email before it takes effect.
